Terms of Service

1. Service provider
CostPact is a service provided by Tomato Design S.L., Tax ID (CIF) B86800372, registered address Urb Cerro Alarcón 1, 28210 Madrid, Spain (the "Provider"). Contact: hola@costpact.io.
2. Scope
These terms govern the subscription to the CostPact software-as-a-service: AI-assisted construction budgeting, cost control, certifications and related features. The service is aimed primarily at construction and renovation professionals and companies.
3. Plans, pricing and taxes
Current plans and prices are those published at costpact.io. Unless expressly stated, prices do not include VAT (21%). Payment is made in advance for the contracted period (monthly or annual) through a secure payment gateway.
4. Term, renewal and cancellation
Subscriptions renew automatically for equal periods. You may cancel at any time from your account or by writing to hola@costpact.io; cancellation takes effect at the end of the paid period. No minimum commitment.
5. Right of withdrawal
If you contract as a consumer, you have 14 calendar days to withdraw. By requesting immediate access to the service you expressly consent to its performance, so the right of withdrawal lapses once the service has been fully performed within that period (art. 103.m of the Spanish Consumer Act).
6. Account and acceptable use
You are responsible for keeping your credentials confidential and for all use of your account. Reselling the service, unlawful use or attempts to access third-party data are not permitted.
7. Your data and content
The budgets, projects and data you enter remain yours. You grant us a limited licence to process them solely to provide the service. Personal data processing is governed by our Privacy Policy and, where applicable, a data processing agreement (art. 28 GDPR).
8. Availability and support
We work to keep the service continuously available, subject to maintenance windows and reasonable circumstances beyond our control. Support is provided by email at hola@costpact.io.
9. Nature of outputs and liability
Budgets and estimates generated by CostPact are professional support tools built from real project data; review and final decisions always rest with the user. To the maximum extent permitted by law, the Provider's total liability is limited to the amounts paid by the customer in the 12 months preceding the event giving rise to it.
10. Intellectual property
The software, the works catalogue and all elements of the service are owned by the Provider or its legitimate right-holders and are protected by intellectual and industrial property law.
11. Assignment of the contract
The Provider may assign this contract, with all rights and obligations arising from it, to a group company or a newly incorporated company that continues operating CostPact (in particular, PactStream S.L., currently being incorporated), with these terms and the customer's rights remaining fully in force. Customers will be notified of any assignment. Customers may not assign their contract without the Provider's prior consent.
12. Changes
We may modify these terms or prices with at least 30 days' notice. If you do not agree, you may cancel before they take effect; continued use constitutes acceptance.
13. Governing law and jurisdiction
These terms are governed by Spanish law. Disputes will be submitted to the courts of Madrid, unless you act as a consumer, in which case the legally applicable forum will apply.
